Terms of use

Effective 23 October 2026 · 中文版

In short

  • Gotcha is an information tool. It doesn't give medical or nutrition advice, and its information may be incomplete or wrong, so always check the pack.
  • Premium is billed by Apple. Monthly and annual plans renew automatically until you cancel in your iPhone's Settings.
  • You let us use, edit and publish the photos and product details you contribute.
  • Your rights under New Zealand and Australian consumer law aren't affected by these terms.

1. About these terms

These terms apply to the Gotcha (查明白) app and the website chamingbai.com. “We” means the developer who runs Gotcha (see the privacy policy). By downloading or using Gotcha, you agree to these terms and the privacy policy.

Gotcha is distributed through the App Store, so Apple's Licensed Application End User License Agreement (the standard EULA) also applies. These terms add to it; if the two conflict, Apple's standard EULA prevails.

2. An information tool, not medical advice

  • Gotcha helps you understand products using public supermarket listings, user contributions and published official guidance. It does not give medical, nutrition or dietary advice and is no substitute for a doctor, registered dietitian or other professional.
  • Product information, translations, scores and alerts can be incomplete, out of date or wrong: supermarket data has errors, recipes change, and translations and photo reading are done by AI, which makes mistakes.
  • If you have an allergy or intolerance, read the ingredients and allergen statement on the pack every time you buy or eat a product. Gotcha's alerts are an aid, not a replacement for reading the label.
  • Health scores and “For you” results are our own calculations using a published method (see how scoring works), not official ratings. The nutrition part follows the public Health Star Rating (HSR) algorithm; where the pack doesn't show an HSR, the result is our estimate.
  • Product information and reference prices follow the country you choose in the app (New Zealand or Australia). The product sold under the same barcode can differ between the two countries in recipe, allergens and price.
  • Reference prices come from one store on one day. They aren't live prices. They are in New Zealand dollars in New Zealand and Australian dollars in Australia.

3. Your account

  • You can use Gotcha's core features without signing up. To claim rewards for contributions and invitations, you need to sign in with Apple or Google.
  • Keep your phone and sign-in method secure. You are responsible for what happens through your account.
  • You can delete your account at any time on the Me page in the app. The privacy policy explains what deletion does.

4. Free features and Premium

  • Scanning, translations and allergen alerts are always free.
  • Premium adds features such as several health goals, family profiles, full scan history and saved products. The Premium page in the app describes exactly what's included.

5. Subscriptions and payment

PlanNew Zealand price (incl. GST)Notes
MonthlyNZ$4.99/monthRenews automatically
AnnualNZ$29.99/yearRenews automatically; 7-day free trial for new subscribers
LifetimeNZ$79.99One-off purchase; never renews
  • The table shows New Zealand prices. In Australia and elsewhere you pay the local price shown on the App Store, including local taxes. The price shown on the App Store at the time of purchase applies. Apple charges your Apple Account; we never receive your payment details.
  • Monthly and annual plans renew automatically: unless you turn off auto-renew at least 24 hours before the end of the current period, Apple renews it at the then-current price and charges you.
  • Annual free trial: cancel at least 24 hours before the trial ends and you won't be charged; otherwise the annual price is charged when the trial ends (NZ$29.99 a year in New Zealand; elsewhere as shown on the App Store).
  • To cancel, open Settings on your iPhone, tap your name, then tap Subscriptions. After you cancel, Premium continues until the end of the period you've paid for.
  • Family Sharing: Premium works with Apple Family Sharing, so up to 5 other members of the buyer's family group can use it.
  • Refunds are handled by Apple under its policies; request one at reportaproblem.apple.com.
  • On a new phone or after reinstalling, tap Restore Purchases on the Premium page in the app.
  • If a subscription price changes, Apple notifies you in advance under its rules.

6. Reward days

  • Contributions: each approved, complete contribution earns 1 day of Premium. Complete means clear photos of the front of the pack, the ingredient list and the nutrition panel for a food, details that pass our checks, and a product we didn't have or information it was missing (nutrition panel or ingredients). Each person is rewarded once per barcode.
  • Invitations: when a friend signs in with Apple or Google (on an account created in the last 30 days) and enters your invitation code, you each get 7 days of Premium. Each device counts once.
  • You need to sign in to claim rewards. Rewards earned before you sign in are kept and given to you when you do.
  • If you're subscribed, reward days are saved and start when your subscription ends. Lifetime members don't need reward days.
  • Reward days have no cash value and can't be transferred, exchanged for cash or refunded.
  • We may change reward amounts and rules, or end the rewards programme; days already given are not affected.
  • If we find reward abuse, such as repeated or fake contributions, or using several accounts or devices to claim invitation rewards, we may withhold or remove the rewards involved.

7. What you contribute

“Your content” means the photos you contribute, the product details you check or correct, and the problem reports and feedback you send.

  • You confirm that you took the photos or have the right to share them, and that what you send is accurate.
  • Photograph only the pack. Don't include faces, other people, ID documents, receipts or anyone's private information.
  • You give us a worldwide, non-exclusive, royalty-free licence to use, copy, store, edit (including cropping and removing faces and background), translate, display and publish your content in the Gotcha app, on our website and in our product information, and to let our service providers process it for those purposes.
  • Because other users keep relying on the product information, this licence continues after you stop using Gotcha. If you ask us to delete a photo, we will delete it and stop using it; published facts such as product names, ingredients and nutrition values stay.
  • Your content is reviewed, and we may edit it, not use it, or remove it.

8. Rules of use

When using Gotcha, you must not:

  • scrape, bulk download or copy our product data, translations, scores or dictionaries, or access our service by automated means;
  • interfere with, attack or get around the service's security measures and usage limits;
  • submit content that is false, misleading or infringes anyone's rights;
  • farm rewards with multiple accounts or by other means;
  • use Gotcha's scores or content in advertising or promotion for a product without our written permission;
  • use Gotcha unlawfully.

If you break these rules, we may restrict or suspend your use and cancel the rewards involved.

9. Intellectual property

The Gotcha app and website, and the explanations, translations, scoring method and dictionaries we produce, belong to us or are used under licence. Product names, brands and trade marks belong to their owners. Gotcha isn't affiliated with any brand or supermarket, carries no ads and takes no payment from brands. We don't use the official Health Star Rating star logo.

10. Third-party services

Gotcha links to third-party websites such as supermarket sites, and uses third-party services such as Apple, Google and RevenueCat. They are provided under their own terms, and we aren't responsible for their content.

11. Changes to the service

We keep improving Gotcha and may add, change or remove features. If we decide to stop offering Gotcha, we will give notice in the app first. You can stop using Gotcha and delete your account at any time.

12. Your consumer rights

If you use Gotcha as a consumer, nothing in these terms excludes or limits your rights under New Zealand law, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986, or, in Australia, the consumer guarantees under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010), including those that cannot be excluded. These terms apply only to the extent those laws allow.

13. Limitation of liability

To the extent the law allows:

  • Gotcha is provided “as is”. We work to keep information accurate, but we don't guarantee that it is complete or accurate, or that the service will always be available;
  • we are not liable for indirect loss, loss of profit or loss of data arising from using or relying on Gotcha's information;
  • our total liability to you is limited to the amount you paid for Gotcha in the previous 12 months.

These limits don't affect your rights described in section 12, or any liability that the law doesn't allow us to limit.

14. Governing law

These terms are governed by New Zealand law, and New Zealand courts have jurisdiction over disputes about them. This doesn't affect any rights you have under the mandatory laws of the country you live in, such as the Australian Consumer Law.

15. Changes to these terms

We may update these terms. We will give notice of significant changes in the app or on this website before they take effect. If you keep using Gotcha after an update takes effect, you accept the new terms.
